Homeowner | Terms of Use (Kijanix Builds)

These Terms of Use (“Terms”) govern access to and use of the Kijanix website and related services (“Site” or “Services”). By using the Site, you agree to these Terms.

1. Company Role and Nature of Services

Kijanix provides administrative, coordination, and facilitation services connecting homeowners with independent third-party construction contractors. Kijanix does not:
  • Perform construction work
  • Act as a general contractor
  • Supervise or direct construction activities
  • Guarantee workmanship, timelines, or project outcomes
  • Enter into construction contracts with homeowners
All construction services are performed by independent third-party contractors (“Contractors”) who contract directly with the homeowner.

2. No Construction Contract Relationship

Any agreement for construction services is strictly between the homeowner and the Contractor. Kijanix is not a party to any construction agreement, including but not limited to agreements related to:
  • Concrete installation
  • Driveways, slabs, or pads
  • Excavation or site work
  • Any residential construction services
Kijanix has no contractual obligation to complete or oversee construction work.

3. Independent Contractors

All Contractors referred through Kijanix are independent businesses and are not:
  • Employees of Kijanix
  • Agents of Kijanix
  • Joint venturers with Kijanix
Kijanix does not control, direct, or supervise Contractor work.

4. Payment Processing and Escrow Services

Payments for construction services may be processed through third-party escrow providers, including platforms such as Trustap or similar services. Kijanix:
  • Does not guarantee payment outcomes
  • Does not hold construction funds as a fiduciary (unless explicitly disclosed in writing)
  • Is not responsible for payment disputes between homeowners and Contractors
All payment disputes must be resolved through the applicable escrow provider and/or directly between homeowner and Contractor.

5. No Guarantees or Warranties

Kijanix makes no warranties or representations regarding:
  • Contractor performance or workmanship
  • Project timelines or completion dates
  • Pricing accuracy of contractor estimates
  • Permitting, inspections, or code compliance
Any estimates or information provided are for informational purposes only.

6. User Responsibilities

Users agree to:
  • Independently evaluate and select Contractors
  • Review and approve all construction work directly with Contractors
  • Enter into binding agreements directly with Contractors
  • Ensure all project requirements are clearly communicated to Contractors

7. Limitation of Liability

To the fullest extent permitted under Texas law, Kijanix shall not be liable for any:
  • Construction defects
  • Property damage
  • Personal injury
  • Project delays
  • Contractor misconduct
  • Financial losses arising from construction services
Kijanix’s total liability, if any, shall be limited to the amount paid for Kijanix’s facilitation services (if applicable).

8. Indemnification

Users agree to indemnify and hold harmless Kijanix, its owners, employees, and affiliates from any claims, damages, or losses arising from:
  • Construction work performed by Contractors
  • Disputes between homeowners and Contractors
  • Use of third-party escrow services
  • Site conditions or project execution

9. Third-Party Services

The Site may link or integrate with third-party services, including escrow providers and Contractors. Kijanix is not responsible for:
  • Third-party service performance
  • Third-party terms or policies
  • Disputes involving third-party services

10. No Professional Advice

All content provided through the Site is for general informational purposes only and does not constitute:
  • Engineering advice
  • Construction advice
  • Legal advice
  • Financial advice

11. Modifications to Services and Terms

Kijanix reserves the right to:
  • Modify these Terms at any time
  • Update service offerings
  • Change platform functionality
Continued use of the Site constitutes acceptance of updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be brought in courts located in Texas.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between the user and Kijanix regarding use of the Site and supersede any prior communications.
